Web Marketing Conversion Lab, SRL, hereinafter the “Responsible“, with trade name “MIWEB” for Mexico and the United States and “Extendo” for Central and South America, with address in San José, Costa Rica, issues this Privacy Notice, which governs the website “Web Page” and its application in the United States of America, the United Mexican States, the Republic of Costa Rica, as well as the countries in which the Responsible Party has a presence, so that the Owner of the personal data, from now on called “Holder”, is aware of the treatment that the Responsible gives to their Personal Data.

 

The information of the holders, or the means of communication by which it is accessed, can be verbal, written, electronic, optical and other technology, such as the Internet or by telephone.

Personal Data that We Collect:

The Personal Data that the Responsible of the Holders collects are Identification Data, Contact Data, Tax Data and Labor Data. No treatment is given to Sensitive Data.

Purposes of the Treatment of Personal Data

The data collected will be used for the following purposes:

  • Original Purposes: The information is collected, used and stored to provide contracted services; service request process, design and quote submission; integrate and verify files required by law for the provision of the Service or to grant Products; fulfillment of rights and obligations of the main products and services or contracted accessories, all of the above purposes are essential for the celebration of the Legal-Commercial Relationship, or, for the attention to the request of the Holder.
  • Secondary Purposes: They are used for statistical purposes, to evaluate the quality of the service, to offer and promote products and services; inform by any means about changes or new products that are related to the interests of the Holder; evaluate the quality of the services and/or products offered, as well as the quality of attention to your comments or requests.

Transfer of Personal Data

The Responsible declares that it will not transfer any type of information of the Holder to national or foreign third parties, otherwise, the Holder will be informed by publishing a new privacy notice. The foregoing in accordance with the provisions of article 36 of the Regulations of the Federal Law on Protection of Personal Data Held by Private Parties.

 

In terms of the applicable regulations, the Responsible party transfers personal data of the Holder to controlling companies, subsidiaries or affiliates under the common control of the person in charge, or to a parent company or to any company of the same group of the Responsible, inside or outside the aforementioned countries, which are located in the countries indicated by the web page of the Responsible, and that operate under the same internal processes and policies as the Responsible, which is why express consent is not required to make said transfer. The transfer would be made so that, with the intention of facilitating or coordinating the User with the Responsible Party, the purposes of providing contracted services are fulfilled; service request process, design and quote submission; integrate and verify files required by law for the provision of the Service or to grant Products; fulfillment of rights and obligations of the main products and services or contracted accessories.

Exercise of ARCO Rights

The Holder has the right, personally or through a Representative, to request, at any time, Access, Rectification, Cancellation or Opposition, regarding the personal data processed by the Responsible.

For the above, the Holder must send by email a Request in  writing with the following Requirements:

  • The name of the holder, address and email to communicate the response to your request.
  • The only documents that will be accepted as proof of identity that will only be accepted are voting credentials, passport, military service card, or both sides of the Immigration Card, attached as a clear and legible image to the mail.
  • If it is done through a representative, the identification of the representative and power of attorney signed by two witnesses to act on behalf of the owner will also be presented, attaching an image of the power of attorney and identification that are legible and clear.
  • The relationship that he maintained or maintains with the person in charge.
  • The clear and precise description of the personal data with respect to which it is sought to exercise any of the rights of access, rectification, cancellation or opposition to them.
  • If applicable, the modifications to be made and provide the documentation that supports your request.
  • The letter is addressed to the person in charge and the request is sent to the email info@extendo.cr.

The Responsible Party will communicate to the Owner, within a period of twenty business days from the date on which the request for access, rectification, cancellation or opposition was received, the determination adopted to the same email indicated. When the person in charge receives the request that has entered our server, it will be answered with an Acknowledgement of Receipt.

Once the response has been sent within the indicated period, the Responsible will have 15 business days to execute the Access, Rectification, Cancellation or Opposition of the personal data according to the request. The response, and where appropriate, sending the information will be by email. In the event that the owner so decides and that it proceeds, the information will be sent to the means indicated for such purposes by the owner, as long as the owner requests it and pays the justified or justifiable shipping or with the cost of reproduction in copies or others formats.

Limit of use or disclosure of Personal Data

In order for the Holder to exercise his right to limit the use or disclosure of personal data, but with the intention of continuing to use the services provided by the Responsible, the user must express this in writing to the following email info@extendo.cr, which includes the following points:

  • The name of the owner, address and email to communicate the response to their request.

All that data that has been limited, has a record that is registered in a Public Registry or that has been Opposed, will be given the same treatment expressed in this title and will be included in an exclusion list of the Responsible. 

Personal data that has fulfilled its purposes, but cannot be canceled and/or deleted by law or contract, will be blocked from the purposes to which it was submitted, until it can be deleted. During this period, personal data may not be subject to treatment beyond conservation and protection.

Regarding the Personal Data, related to the exploitation of the image, that may be used by the Responsible Party, said use will be covered solely and exclusively by the contract entered into with the owner or his legal representative, as well as the provisions applicable regulations on Copyright, supplementary or equivalent.

Use of Cookies or any technology to collect information

The owner, when entering the “Web Page” page, acquires the quality of “User”. Cookies are used on the website, “Cookies” from here on.

The Responsible, as well as the Owner, acknowledge that this Privacy Notice is of unlimited validity. However, the Responsible will try to keep this Notice updated. The publication of the Modifications to the Privacy Notice will be generalized for all owners. The Reforms to the Privacy Notice may be made known to the Owner through a notice on the Responsible Page, email, by telephone or in writing.

Consent

Due to the fact that the data is collected directly from the Owner, that this Privacy Notice has been made available to the owner, prior to the use of their Data and that none of the data processed by the Responsible Party is sensitive, patrimonial or financial, It will not be necessary for the Holder to expressly express his consent, so the Holder consents to this Privacy Notice in accordance with the Law on Protection of Personal Data Held by Private Parties without opposing it.

Revocation of consent

The owner may revoke, at any time, their consent with this Privacy Notice and with the Treatment of their Personal Data.

To revoke the consent, the Holder must send a Request to the email info@extendo.cr which must be in writing with the following requirements:

The Responsible will issue a response in which it will confirm the revocation of consent, or where appropriate, will indicate the reasoning depending on the specific case, with the Responsible having 15 days to issue this response.

The deadlines will be counted from the moment the mail enters our server, issuing the Responsible the respective Acknowledgement of Receipt of Request.

The Request will not be valid if the above is omitted.

Internal Privacy Area

The owner may exercise their rights and make the inquiries indicated in this document, as well as in the law, through the Privacy area of ​​the Responsible Party, to which the Requests indicated in this document must be addressed and in the Law. The User will have to use the multi-referred email address info@extendo.cr to contact the Privacy area. 

Please note that this Privacy Notice will be updated periodically to reflect any changes in the way we handle your personal data or any changes in applicable laws. If we make a material change to the way we process your personal data, we will provide you with notice and, if legally required, seek your consent.
